Scope & Acceptance
The “Free Website Build” includes only the design, development, features, and functionality expressly stated in your agreed website brief.
We reserve the right to refuse a website brief or project application for any reason prior to, or after accepting your order.
Acceptance of your website brief is when we inform you that your website is being built via a ticket within my.freewebsitebuild.co.uk
Free Trial
1. The free trial is provided for a term of 7 calendar days.
2. The free trial begins once your website has been delivered
Delivery
1. Your website is considered as “delivered” when we provide you with login details to your website’s CMS (“Content Management System).
The Hosting Condition
Because the design and build are provided free of charge, this service is strictly conditional on the website remaining hosted with us.
You agree to pay the applicable ongoing hosting fees ("Ongoing Running Costs") for the duration of the website's lifespan on our servers.
Ongoing Running Costs
1. Your Ongoing Running Costs cover the provision of the hosting environment and include:
Standard website hosting;
Maintenance of the server/hosting environment;
Provision of an SSL certificate; and
Daily automated backups (retained for a maximum of 30 calendar days). Note: Backups are provided as a standard recovery measure. We do not guarantee that all website data can be perfectly restored in every circumstance, and you are encouraged to keep your own offline copies of essential text and images.
2. Unless expressly quoted and agreed in writing, your Ongoing Running Costs do not include:
Updates to website content, images, products, or pages;
Website design changes, redesigns, or new functionality;
Technical support for software, email, or issues unrelated to the hosting environment;
Domain name registration, renewal, or transfer fees;
Copywriting, photography, or video production;
Costs for premium plugins, software, themes, or third-party services; or
Search engine optimisation (SEO) or guaranteed search rankings.
Intellectual Property
Our Property: Because the build is free, we retain all intellectual property rights in the website’s design, custom code, layout, structure, templates, and any other underlying materials created by us.
Your Property: You retain full ownership of the text, images, logos, branding, and other materials you provide to us to include on the website.
Transfer, Migration, and Buyout
You must not copy, scrape, extract, reproduce, reverse-engineer, or otherwise attempt to transfer the website’s design, code, layout, structure, or functionality to another hosting provider.
This restriction does not prevent you from extracting and keeping the text or images that you supplied to us.
If you wish to migrate the complete website (including our design and code) to another provider, you must first obtain our written agreement and pay a transfer/buyout fee of £3,800. Upon payment, we will grant you a licence to use the design elsewhere and package the site for transfer.
Termination and Suspension
If you fail to pay your Ongoing Running Costs, or if you breach these terms, we reserve the right to suspend or terminate the hosting service. Upon termination without a buyout fee being paid, the website will be taken offline, and you will not have the right to take the website design or codebase with you.
